Terms and Conditions for Promotional Offers & Credits

These Terms and Conditions for Promotional Offers and Credits (collectively “Offers”) on Buzzer (the “Program Rules”) are provided by Buzzer Technologies Inc. (“Buzzer," “our,” “us” or “we”) for the purpose of promoting and offering the Buzzer Promotional Offers & Credits program (the “Program") to qualifying Buzzer account holders (“you” and “your”). 

The Buzzer Terms of Use (the “Terms”) and Privacy Policy, apply for all Offers. In addition, the Program Rules listed below apply to each promotion and/or credit program as indicated. All capitalized terms not defined herein shall have the meaning ascribed to them in the Terms.The Program is void where prohibited or restricted by law.

1. Program. By taking certain actions described in these Program Rules, in email communications or in-app messages received by you from Buzzer (“Qualifying Actions”), you may be eligible to accumulate certain credits (“Buzzer Credits”), as set forth herein, in such emails and in-app messages. Qualifying Actions are subject to change, and the availability of any Qualifying Actions at a particular time does not imply or warrant that they will be available at any time. We reserve the right, in our sole discretion, with or without prior notice, to suspend, cancel or modify the Program at any time and for any reason, and/or to add, delete, change or revise the Program Rules (including, but not limited to, qualifications for participation in the Program), to limit the available quantity of or discontinue the Buzzer Credits or any other Program offers or promotions, to void any Buzzer Credits, to bar any user from redeeming any accumulated Buzzer Credits or remove Buzzer Credits from a user’s account, or to refuse to provide any user with any Buzzer Credits. Buzzer Credits, the number of Buzzer Credits, and the redemption value of Buzzer Credits and any restrictions on the use of Buzzer Credits, are issued at Buzzer’s sole discretion.

2. Eligibility. In order to be eligible for the Program and accumulate Buzzer Credits, you must (a) have an active registered account on Buzzer’s Services and not be in breach of any of the Terms and (b) complete a Qualifying Action. If you are eligible and have completed a Qualifying Action, you must follow any instructions on the Services to accumulate applicable Buzzer Credits. Your eligibility to participate in the Program and to accumulate and/or redeem Buzzer Credits is subject to Buzzer’s sole discretion at all times.

3. Buzzer Credits. Unless otherwise described as part of the Qualifying Actions, any Buzzer Credits issued shall be automatically applied to your Buzzer account. Buzzer Credits may only be used to watch live sports moments on the Services pursuant to the Terms. Buzzer Credits are not cash, and cannot be redeemed for cash or cash equivalents. Buzzer Credits may only be redeemed by you solely and exclusively through an applicable Qualifying Redemption; they have no other use, value or purpose. Buzzer Credits may only be redeemed by the user who accrued them.  Unless otherwise indicated, Buzzer Credits expire three (3) months from the date of issuance. In order to redeem accrued Buzzer Credits, you must establish and maintain an active Buzzer account and not be in breach of any of these Program Rules. By accumulating and redeeming Buzzer Credits, you agree to all of the Program features, limitations and requirements and restrictions contained in these Program Rules. You acknowledge and agree that if you elect to terminate or delete your Buzzer account before you have redeemed all accrued Buzzer Credits, you abandon any claim and forfeit all rights to the remaining Buzzer Credits in your account at that time. Buzzer shall not be liable to you for any Buzzer Credits in your account upon any termination of your account. All redemptions are final. 

4 Promotional Codes.  From time to time, we, or others acting with our permission, may offer you promotional codes to redeem Buzzer Credits.  Promotional codes will expire on the date indicated in the communication to the Buzzer account holder with the promotional code; if no date is specified, the promotional code will expire within three (3) months from the date the promotional code was published in any form (including online).  To redeem the promotional code and apply it to your Buzzer account, the Buzzer user should follow the instructions in the Offer.  Promotional codes may be limited to a one-time use as indicated in the offer. Unless otherwise indicated in the Offer, all promotional codes are limited to one per person.

5. Additional Limitations. You may not transfer any Buzzer Credits to other users of the Services or third parties, or cause Buzzer Credits accumulated for a Qualifying Action to be credited to another user. Buzzer Credits and Promotional Offers are intended for personal use only. Commercial use is prohibited. Buzzer Credits are not targeted towards, nor intended for use by, anyone under the age of 13. Without notice to you, Buzzer reserves the right to suspend or terminate any account or remove accumulated Buzzer Credits from your account, if Buzzer determines, in its sole discretion, that you have violated these Program Rules or that your use of the Buzzer Credits or Promotional Codes is unauthorized, deceptive, fraudulent or otherwise unlawful.

6.Legal Obligations. It is your responsibility to ascertain and obey all applicable local, state, federal, and international laws (including minimum age requirements and tax obligations) in connection with redemption of Buzzer Credits and Promotional Offers. You acknowledge that you will be solely responsible for determining and paying any and all tax liability arising out of the consideration received in connection with Buzzer Credits and Promotional Offers. In no event shall we or any of our affiliates or agents be responsible or liable to you for any indirect, special, exemplary, punitive or consequential damages, including without limitation lost revenue, lost profits, or lost opportunity, in connection with or relating to the Program or its administration, or that result from the use of or inability to use the Program or Buzzer Credits, even if we have been made aware of the possibility of such damages. In addition, we make no warranty or representation either expressed or implied, and expressly disclaim any and all liability and damages with respect to the availability or use of the Buzzer Credits and/or Promotional Codes.
